What a Sub-Divisional Magistrate is
A Sub-Divisional Magistrate is the administrative head of a sub-division, a group of tehsils or blocks within a district. The title is used in states such as Uttar Pradesh, Punjab, Haryana and Delhi. Other states use different names for a similar post: Sub-Divisional Officer in Bihar and West Bengal, Revenue Divisional Officer in Tamil Nadu, Andhra Pradesh and Telangana, and Assistant Commissioner in Karnataka.
The SDM reports to the District Magistrate or Collector and supervises the tehsildars below. A sub-division may contain a few tehsils, and the SDM is the officer where state policy meets an individual, whether it is a boundary dispute, a certificate or a relief claim.
Revenue duties
Land records, mutations, tenancy disputes, revenue collection and the settlement of land matters sit with the SDM and the tehsildar under the state's revenue law. In states with heavy land pressure, this is the busiest and most sensitive part of the job.
Citizens deal with the SDM's office for caste, income and domicile certificate appeals, permission for events and processions, and attestation of some documents.
An example: after a landowner dies, the heirs apply for mutation, which changes the revenue record to their names. The tehsildar usually decides the case, and a person unhappy with the order can appeal to the SDM. This route is common in many states, though the exact steps depend on the state's land revenue law.
Magisterial powers
An SDM is an Executive Magistrate under the criminal procedure law. This was the Code of Criminal Procedure (CrPC) and is now the Bharatiya Nagarik Suraksha Sanhita. The SDM can issue orders to prevent a breach of peace, such as a ban on gatherings under the provision that used to be Section 144 of the CrPC and is Section 163 of the BNSS.
The SDM also supervises the police's role in keeping order, acts during communal tension, and in some states handles arms licences. An SDM is not a police officer and does not investigate crimes.
Orders under these provisions are meant to be temporary and limited to a place and a period, and a person affected can challenge them before a higher authority or a court. The Supreme Court has said such powers must be used only where there is a real threat to public order, and cannot be used to suppress legitimate protest.
Elections, disasters and relief
During elections an SDM often works as a Returning Officer or Assistant Returning Officer for the assembly constituency, depending on the state's arrangement. In floods, fires and other disasters, the SDM coordinates relief, surveys damage and recommends compensation.
The job is known for being close to the ground, with field visits, court work and long hours on duty days. It is also the posting where a new officer learns how a district actually runs.
A short checklist for a citizen visiting the office: carry an application in writing, copies of your identity proof and land or residence papers, and the receipt of any earlier application. Ask for the receipt of the new one. Most offices have fixed hours for meeting the public, so check the day and time on the notice board or the district website before going.
How the career ladder works
An IAS officer usually serves first as SDM, then as Additional District Magistrate or Joint Collector, and later as District Magistrate or Collector. Officers of the state civil service can also be posted as SDM, often early in their careers, and may rise to ADM and then be promoted to the IAS later.
An SDM is not the police chief of a district. That is the Superintendent of Police, who belongs to the police service and works alongside the DM.
SDM and look-alike titles
The SDO title means the same civil post in many states, but in power or public works departments SDO is an engineering officer. The tehsildar works under the SDM at tehsil level. When a title appears on a document, the department named next to it tells you which one it is.
SDM questions appear in SSC, UPSC and state PSC exams, especially the full form, the rank and the magisterial powers.
Citizens go to the SDM when a tehsil-level office does not act, for example when a mutation order or a certificate is delayed. A written application, with the receipt of earlier applications attached, gets noticed. You can also use the state's public grievance portal or an RTI application to find out where your file is stuck.
The SDM is the first line of district administration. Knowing what the post does helps you read a news report or a government order and know where to take a problem.
