Scheduled Tribe: what the category means in law

Under Article 342 of the Constitution, the President notifies the tribes or tribal communities that count as Scheduled Tribes in each state or Union Territory, and Parliament can add or remove entries by law. Only a community on that notified list for your state can use the category. The certificate is valid because of the notification, not because of self-identification or a family story about ancestry.

The category brings reservation of 7.5 per cent in central government jobs and in central educational institutions, alongside the SC and OBC quotas, plus reserved seats in the Lok Sabha and state assemblies for designated constituencies. Many states also run hostels, scholarships and fee support for ST students, though the schemes change with each government. Separately, the Fifth and Sixth Schedules of the Constitution deal with the administration of tribal areas, which is a different matter from the list of Scheduled Tribes.

Getting the certificate without running in circles

The application goes through the revenue or welfare machinery at the district or tehsil level, where officials verify school records, parentage, address and the notified list of tribes for that state. Rules vary: some states accept school certificates as evidence and others want revenue records going back a generation.

Documents usually asked for are an application form, proof of address, a school leaving certificate or other record that names the tribe, a father's or grandfather's certificate where one exists, and an affidavit. Check the current checklist at your tehsil office or the state's service portal before you pay for photocopies.

An ST certificate is tied to the state where your tribe is notified. A person who migrates may not automatically be treated as ST in the new state, since the list for each state differs, so ask early if a move is planned.

Keep scanned copies of every document and the receipt of the application, because a rejected file is usually sent back for a missing paper and not for a wrong claim. If a certificate is delayed beyond the stated service period, most states have an appeal route to a senior officer.

ST, SC and OBC are three different lists

SC covers castes that historically faced untouchability and exclusion, listed by presidential order under Article 341. ST covers tribal communities with a distinct language, habitation and way of life, often living away from caste society. OBC is the broadest of the three, a long list of socially and educationally backward classes identified after the Mandal Commission and later reviews, and it applies a creamy layer test that SC and ST do not. Each has its own list, its own certificate and its own reservation share: 15 per cent for SC, 7.5 per cent for ST and 27 per cent for OBC in central posts.

Why the reservation exists at all

The category was written into the Constitution to correct long exclusion from education, land and public office, not to reward anyone. Supporters point out that recruitment targets are still missed in many departments and that first-generation learners from tribal villages need a foothold. Critics argue about quotas, exclusions and whether the remedy should be economic instead. Whatever your view, the mechanism exists because the framers wanted opportunity kept open while institutions caught up.

Outside government paperwork the letters travel. On old invoices and state-level documents ST has meant sales tax, from before GST replaced most such taxes. In timetables and news copy ST often stands for standard time, as in Indian Standard Time running five and a half hours ahead of Greenwich. In finance and HR you will see short term for deposits, postings and agreements. Anyone who grew up in Maharashtra reads ST instantly as State Transport, the red buses of the state fleet that people still call ST buses.

Read ST on a form and the context settles it within a second: a caste certificate means Scheduled Tribe, an old bill means sales tax, a timetable means standard time. For students and job applicants the certificate decides eligibility, so get the paperwork verified early rather than at the last counter.
