Reverse charge: flipping who pays the GST

Normally the supplier adds GST to the invoice, collects it from the buyer and deposits it with the government. Under reverse charge the recipient works out the tax and pays it to the government directly. The supplier's invoice may show no tax, but the buyer still owes the full amount.

The legal basis is Section 9(3) of the CGST Act, 2017, which lets the government notify categories of goods or services on which the recipient pays, and Section 9(4), which covers certain supplies from unregistered persons that are notified. Import of services by an Indian business from a foreign supplier is taxed as IGST on reverse charge under the IGST Act.

Where you meet RCM in practice

Common reverse charge cases include legal services from an advocate or firm of advocates, goods transport agency services where the GTA has not opted to charge GST itself, sponsorship services, certain services from government departments, and renting of a residential dwelling to a registered person. Each is listed in notifications issued with the GST rate schedules.

Imports of services are the everyday second case. If your company pays for a cloud subscription from a foreign provider or for a consultant abroad, you pay IGST yourself under reverse charge. Imports of goods are different: IGST on them is collected at customs along with duty.

The list changes with notifications and Council decisions, so check the current notification rather than older advice.

Compliance points taxpayers often miss

A supplier does not raise a tax invoice for the reverse charge portion, so the recipient prepares a self-invoice where required, along with a payment voucher when the payment is made. The supplier's own document should state that tax is payable on reverse charge. Second, the tax must be paid in cash through the electronic cash ledger, because input tax credit cannot be used to settle a reverse charge liability.

The credit itself is available once the tax is paid, if the purchase is for business and the other conditions are met. The cash-flow cost is therefore usually the real complaint, not the final tax cost. The recipient reports the liability in GSTR-3B and the supplier reports such supplies in GSTR-1.

Record keeping is part of compliance. Keep the vendor's document, your self-invoice, the payment voucher, the challan and the return entry together for each reverse charge purchase, because an officer reviewing your return will look for that chain.

A worked example of reverse charge

A registered company in Pune pays a law firm 1,00,000 rupees for legal advice. Legal services from an advocate to a business are on reverse charge, so the law firm bills the fee and mentions that tax is payable by the recipient. At 18 per cent, the company owes 18,000 rupees as GST. It pays that amount in cash through its electronic cash ledger, reports it in its monthly return, and then claims the same 18,000 rupees as input tax credit if the service is used for business.

The recipient must be registered under GST, and a registered business is identified by its GSTIN, which should be quoted on the invoice. If you are unsure whether a purchase falls under reverse charge, ask the vendor for the HSN or SAC code and compare it with the current notification.

Revenue Cycle Management in Indian hospitals

In healthcare, RCM covers everything from patient registration and insurance pre-authorisation to coding, claim submission, denial management and final collection. The goal is to shorten the gap between treatment and payment and to lose as little as possible along the way.

Indian hospitals run this through insurers, third-party administrators (TPAs) and government schemes such as Ayushman Bharat PM-JAY. Denials usually trace back to missing pre-authorisation, mismatched diagnosis codes or documents that never reached the insurer. This makes the pre-authorisation desk a revenue function, not just an administrative one.

One GST point surprises people: services by clinical establishments for treating patients are exempt, but some charges, such as room rent above a set daily limit, can attract tax. Revenue cycle teams work with both sets of rules.

Before you quote RCM in an invoice, return or report, confirm whether the context is tax under the Reverse Charge Mechanism or hospital Revenue Cycle Management, since the two have nothing else in common.

RCM Full Form: Common Questions

What is the full form of RCM?

In GST, RCM stands for Reverse Charge Mechanism, where the recipient pays the tax. In hospitals and healthcare finance it stands for Revenue Cycle Management.

Who pays GST under the Reverse Charge Mechanism?

The recipient. The buyer of notified goods or services works out the tax and deposits it with the government instead of the supplier collecting it. The buyer can then claim input tax credit on that amount if the purchase is for business use.

Can input tax credit be used to pay reverse charge tax?

No. The tax has to be paid through the electronic cash ledger. Once paid, it appears as credit and can be used against output tax, but the payment itself must be made in cash.

Who issues the invoice when GST is paid under reverse charge?

The recipient prepares a self-invoice where the supplier is unregistered, and issues a payment voucher at the time of payment. The supplier's own document should mention that tax is payable on reverse charge.

Do imports attract GST under reverse charge?

Imports of services do: the Indian recipient pays IGST under reverse charge, for example on foreign software subscriptions and consulting. Imports of goods are taxed at customs instead.

What does RCM mean in a hospital or insurance context?

It means Revenue Cycle Management, the end-to-end handling of a patient's account from registration and pre-authorisation to claim filing, denial follow-up and collection.
