MLA stands for Member of Legislative Assembly. Your MLA is the person elected from your constituency to sit in the state legislative assembly, the Vidhan Sabha, in your state capital. Each constituency elects exactly one MLA.
All 28 states have legislative assemblies, and so do three union territories: Delhi, Puducherry and Jammu and Kashmir. The other union territories do not have one, so they have no MLAs.
Who can be one, and who gets to vote
To contest an assembly election a person must be an Indian citizen, at least 25 years old, registered as a voter in the state, and not disqualified under the law. The voters are all citizens aged 18 or above in that state or union territory. That is what universal adult suffrage means in practice: the vote does not depend on property, education or gender.
A candidate can stand as a party nominee or as an independent. The candidate with the most votes in the constituency wins the seat.
How big an assembly is
The size of each assembly depends on the population of the state. The Constitution sets the limit at no more than 500 and no fewer than 60 members, but an Act of Parliament can allow fewer, as in Goa, Sikkim and Mizoram. Uttar Pradesh has the largest assembly with 403 members, and Puducherry the smallest with 30.
So when a news channel says a party needs a certain number of MLAs to form the government, that number depends on the size of that particular assembly. A majority in Goa and a majority in Uttar Pradesh are very different counts, even though the word MLA means the same in both.
What an MLA actually does
An MLA takes part in making state laws, debates the state budget, and asks questions of the ministers in the assembly. Outside the house the MLA is the person local people approach about roads, water, schools, ration shops and hospitals in the constituency.
Many MLAs also get a fund for local development works, whose size and rules differ from state to state. If you want to know how your MLA is using it, state government websites and the right to information route are the places to look.
Why your MLA is not the same as your MP
People mix these up all the time. Your MP, a Member of Parliament, sits in Delhi and represents a much larger Lok Sabha constituency. Your MLA sits in your state capital and deals with state subjects, which is why a broken local road or a ration shop problem usually ends up at the MLA's door.
Before writing a complaint letter, check whether the issue is state or central. Sending it to the right representative saves weeks.
What happens when an MLA's seat falls vacant
A seat can fall vacant if an MLA resigns, dies, is disqualified, or is elected to another house. The Election Commission then holds a by-election in that constituency, normally within six months, to fill the seat. The new member serves out the rest of the term.
You may also hear about floor tests and defections. If a government's majority is in doubt, the assembly can be asked to vote, and the numbers of MLAs on each side decide the outcome. Rules against changing parties after being elected are in the Tenth Schedule of the Constitution.
An MLA may also be a minister or even the Chief Minister
In a parliamentary democracy, some members of the legislature also run the government. So an MLA can also be a cabinet minister heading a department, or the Chief Minister of the state. That is why you may see one person with two or three titles on a signboard.
