The body behind every Indian election

EC here is the Election Commission of India, set up under Article 324 of the Constitution on 25 January 1950, a day before India became a republic. It directs and controls elections to the Lok Sabha, the Rajya Sabha, every state legislature, and the offices of President and Vice-President. That date is now observed as National Voters' Day.

Sukumar Sen was the first Chief Election Commissioner. He ran the first general election of 1951-52 across a country where most voters had never cast a ballot and many could not read the names of candidates, which is how party symbols became central to Indian polls.

The Commission's independence shows in the small things. It frames the rules for registering electors, recognises parties, decides the poll schedule, and can order a re-poll or countermand an election where conditions require it.

Size, appointment and protection

The Commission began as a single-member body. It became three-member briefly in 1989 and permanently in 1993: one Chief Election Commissioner and two Election Commissioners, who decide by majority.

The President appoints them. Under the Chief Election Commissioner and other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023, names are recommended by a committee of the Prime Minister, a Union Cabinet Minister nominated by the Prime Minister, and the Leader of the Opposition in the Lok Sabha. Before 2023, the Supreme Court had directed a similar committee that included the Chief Justice, and the change to the law has been challenged.

The Chief Election Commissioner can be removed only in the way a Supreme Court judge is removed, by Parliament on grounds of proved misbehaviour or incapacity. Other Election Commissioners can be removed only on the Chief's recommendation. That protection keeps the post out of the government's reach.

Rolls, machines, symbols and the model code

First come the electoral rolls. A citizen who is 18 files Form 6 to enrol, Form 8 for corrections or a change of address, and Form 7 to object to or delete an entry. The Electoral Registration Officer of the constituency decides each claim, and applications can be filed online.

Then the machinery: Electronic Voting Machines paired with the Voter Verifiable Paper Audit Trail, polling stations, staff and security. The Commission also recognises parties, allots symbols under the Election Symbols (Reservation and Allotment) Order, 1968, and monitors candidate spending against the limit set for each constituency.

The model code of conduct begins the day polls are announced. It covers announcements by ministers, use of official vehicles and the conduct of campaigners. Complaints can be sent through cVIGIL, the app the Commission launched in 2018, with a photo or short video as proof.

Two more milestones are worth knowing. Parliament lowered the voting age from 21 to 18 through the 61st Amendment of 1988, and NOTA reached the ballot after the Supreme Court's 2013 judgment in the People's Union for Civil Liberties case.

VVPAT slips and how a dispute is checked

A VVPAT unit prints a slip with the party symbol and candidate name, shows it behind glass for about seven seconds and drops it into a sealed box. Since 2019, slips from five randomly selected polling stations in each assembly segment are counted against the electronic tally.

A mismatch between slip and machine is investigated before the result stands. Litigation over VVPAT counting has continued, so follow the Commission's latest order rather than an older news report.

Three other meanings of EC

In trade and diplomacy stories EC usually means European Commission, the executive arm of the European Union. In Indian property paperwork it means Encumbrance Certificate, the document showing that a property carries no registered loan or legal claim for a stated period. In electronics and engineering it can also mean Electronic Components or Electrical Conductivity, depending on the field.

State Election Commissions are separate again. Articles 243K and 243ZA give them charge of panchayat and municipal elections, with commissioners answerable to the state, not to the Election Commission of India.

In general knowledge, EC is the Election Commission, created by Article 324 on 25 January 1950. Keep it apart from the European Commission and from the State Election Commission that runs your panchayat or municipal poll.
