What the Real Estate Regulatory Authority is

RERA is the short name for the Real Estate Regulatory Authority, the regulator each state sets up under the Real Estate (Regulation and Development) Act, 2016. The Act was passed in 2016, and all its main provisions came into force on 1 May 2017, by which time states had to frame rules and set up authorities. Maharashtra's MahaRERA is among the busiest. People also use RERA for the Act itself.

The idea is disclosure. Before a builder sells a single flat, the project must be registered, the sanctioned plans and layout uploaded, the promoter's record declared, and the money buyers pay kept in an account where it cannot be quietly moved to another project.

Which projects must register

The threshold

A project where the land area exceeds 500 square metres, or where the number of apartments exceeds eight, must be registered with the state authority before it is advertised or sold. Smaller plots are exempt, and ongoing projects without a completion certificate also had to register.

Agents and advertising

Real estate agents must register separately, so a broker's card should carry a RERA registration number, and project advertisements should display the project's number. Marketing an unregistered project is itself an offence under the Act.

Where the money goes

A promoter must keep 70% of the amount collected from allottees in a separate bank account for that project, and may draw from it only against construction progress certified by an engineer, architect and chartered accountant. That single rule is meant to stop one launch being funded with another launch's buyers' money.

What a buyer gets out of it

The Act defines carpet area and requires sale on that basis. It covers the usable area inside the walls and excludes external walls, balconies and common areas, which cleared up much of the carpet-area versus super built-up confusion in brochures.

If the promoter fails to hand over possession by the date in the agreement, the buyer may withdraw and demand the amount back with interest, or stay in the project and claim interest for each month of delay. Complaints go to the authority, and its orders can be challenged before the Real Estate Appellate Tribunal.

Penalties are tied to project cost. A promoter who sells without registering can be penalised up to 10% of the estimated cost of the project and may face imprisonment, and other violations carry penalties of up to 5%. The regulator's real leverage is the registration itself: a project that stops reporting starts losing buyers.

Practical checks before you book

Search the project on your state's RERA portal by name or registration number, and read what is filed there: sanctioned plans, quarterly progress reports, promoter details and any complaints against the promoter. Compare the carpet area shown on the portal with the figure in the sale agreement.

Know the tax side too: under-construction flats attract GST, and a buyer pays a 1% TDS on a purchase above ₹50 lakh. Quarterly progress reports exist for a reason. A slab visible on site should match the percentage reported on the portal. A portal that has not been updated for several quarters is a warning in itself.

RERA registration is not a building permission. A registered project still needs local approvals, so ask for the sanctioned plan and the commencement certificate from the planning authority too. Check also that the agreement follows the model format your state has prescribed, and read the clauses on delay and refund before signing. For a loan, your bank will ask for these documents anyway, and an EMI should not start until you know the possession date in writing.

Complaints and the appeal route

A buyer who has a dispute can file a complaint online with the state authority, usually with a modest fee, and an adjudicating officer decides compensation matters. Orders can be appealed to the Appellate Tribunal and then, on a question of law, the High Court. Many states run backlogs, so keep the registration number, the allotment letter, payment receipts and every email from the builder, since the case is decided on those papers. Agent and builder associations, and consumer forums, can be useful for pressure, but the authority is the proper forum.

RERA made home buying a more transparent transaction by forcing registration and disclosure. Look up the registration number on your state's portal before you pay the booking amount; it takes two minutes and can save years.

RERA Full Form: Common Questions

What is the full form of RERA?

The full form of RERA is Real Estate Regulatory Authority, the state regulator set up under the Real Estate (Regulation and Development) Act, 2016, to register projects and protect home buyers.

Which projects must register under RERA?

Those where the land exceeds 500 square metres or the number of apartments exceeds eight, including ongoing projects that do not yet have a completion certificate. Plots below that threshold are exempt from registration.

How does RERA protect home buyers?

It requires registration and disclosure before sale, defines carpet area, and mandates that 70% of buyer money sits in a project-specific bank account. If possession is delayed, the buyer can seek a refund with interest or compensation.

What is the 70% rule?

Under Section 4 of the Act, a promoter must keep 70% of the money received from allottees in a separate account for that project and may draw only against certified construction progress, which limits diversion of funds into other projects.

What does a RERA registration number guarantee?

It guarantees disclosure and accountability, not the flat itself. Registration is not a building approval, so verify local sanctions and read the portal for complaints and the promoter's record before paying the booking amount.

Where do I file a RERA complaint?

On your state's RERA portal. Each state has its own authority, so a Maharashtra project goes to MahaRERA and a Karnataka project to K-RERA. Keep the registration number and payment receipts ready.
