Settling a dispute on a screen

Online Dispute Resolution is the use of video calls, chat and electronic documents to settle a disagreement. The neutral person, whether a mediator or an arbitrator, does not need to meet the parties in a room. Everyone logs in, submits documents, and a settlement or decision is recorded digitally.

It suits cases where the amount at stake is small compared with the cost and delay of court. A refund refused by an e-commerce seller, a delayed insurance payout or a disputed bank charge are typical examples.

The four ways it can work

Negotiation is the simplest: the two sides talk through a platform, sometimes with software suggesting a fair figure. In mediation a neutral person helps them find a middle ground but cannot force one. Conciliation is similar and is the term used in the Arbitration and Conciliation Act. Arbitration is closest to a court case, because the arbitrator hears both sides and gives a binding award.

Where India uses it

NITI Aayog's expert committee published a policy plan for ODR in 2020, urging courts, regulators and platforms to adopt it. The Mediation Act, 2023 recognises online mediation. SEBI has run an ODR mechanism for securities-market disputes since 2023, and the Reserve Bank runs an online complaint system for bank customers. Some e-commerce and fintech companies have in-house ODR as well.

Courts also use online hearings and e-Lok Adalats for compromise cases. These are court processes and not ODR in the strict sense.

The SEBI route, step by step

An investor with a complaint against a broker or listed company first raises it with that company. If that fails, the complaint goes to the SEBI complaints system, and after that to the ODR platform, where conciliation and then arbitration can follow. Time limits apply at each step, so check the current SEBI circular instead of waiting.

Before you file

Keep documents ready as clear scans: the contract or invoice, chats, emails and payment proof. Read the platform's rules to see who bears the cost and how long a decision takes. A settlement you sign online is as final as one on paper, so read it fully before you click accept.

ODR will not replace courts, but for small money disputes it can be the fastest and cheapest route. Check whether your regulator or the seller offers it before you hire a lawyer.

ODR Full Form: Common Questions

What is the full form of ODR?

ODR stands for Online Dispute Resolution, a way of settling disagreements over the internet instead of in a courtroom.

Is the result of ODR legally binding?

It depends on the method. A mediated settlement that both sides sign is binding as a contract, and an online arbitration award is enforceable like any arbitral award. A negotiation that ends without signing binds nobody.

Does SEBI have an ODR portal?

Yes. Since 2023 SEBI has had an ODR mechanism where investors can take a complaint against a broker or a listed company to a recognised institution if the company's own process has not resolved it.

Who can use ODR in India?

Consumers, small businesses, investors, bank customers and anyone whose contract or platform terms allow it. Criminal offences and matters like divorce generally fall outside ODR.

Does ODR cost money?

It varies. Some regulator-run services for bank customers are free, others charge a fee set by the institution, and private platforms usually charge per case. Check the fee before you file.
