What the FCRA was written to control

The FCRA full form is Foreign Contribution (Regulation) Act. The original law was passed in 1976 and replaced by the FCRA 2010, which came into force in May 2011. The Ministry of Home Affairs administers it.

The aim is narrow: foreign money entering India should not be used to disturb public order or influence elections and legislation. That is why an organisation's objects, office bearers and the stated purpose of each grant all come under scrutiny.

A foreign contribution is a donation, gift or transfer from a foreign source: currency, securities or articles. Money routed through an overseas affiliate can count, even when the original giver is Indian.

The Act also draws a line around people, not just organisations. A political party, a government servant or a company with foreign shareholding faces its own restrictions, so a grant that looks routine to a small trust may be barred for a different applicant.

Who has to register, and with whom

An organisation wanting foreign grants applies for registration on the FCRA portal. The MHA checks the applicant's objects, finances, office bearers and any history of prosecution before granting or refusing. A Darpan ID from the NITI Aayog portal is needed for the application.

A second route exists: prior permission, sought for a specific project or donor when the organisation has no registration. Taking foreign funding without either approval is the violation most often prosecuted.

Registered bodies must receive foreign funds in a designated bank account (under the 2020 amendment, at the State Bank of India's New Delhi Main Branch, with a utilisation account at any bank), submit audited accounts and annual returns, and keep separate books. The 2020 amendment also barred sub-granting to other organisations.

Compliance duties after approval

Registration is valid for five years. Renewal has to be applied for before expiry, and the rules ask for it well in advance, around six months, so check the current rule. Miss that window and the organisation can stop receiving foreign funds until regularised.

Every year the NGO files an annual return in Form FC-4 listing receipts, expenditure and balance, with audited statements from a chartered accountant.

The 2020 amendment lowered the limit on spending foreign contribution on administrative expenses from 50 percent to 20 percent. It also brought Aadhaar or passport details for key office bearers and barred public servants from accepting foreign contribution.

What a violation costs

Breaches range from procedural to serious. Not filing returns draws show-cause notices and non-renewal. Taking foreign funds without approval can lead to cancellation of registration, freezing of funds and prosecution, with imprisonment and fines under the Act.

Cancellation orders are issued routinely, and a large number of registrations have lapsed or been cancelled over the past decade, mostly for non-filing or spending outside the declared object.

This is why grant-making foundations now ask Indian partners for the FCRA certificate, the registration number and the latest annual return before signing anything.

Where FCRA does not apply

Trade between companies, foreign direct investment and loans from international financial institutions sit under other frameworks, not FCRA. Gifts to individuals for personal use up to a limit are also outside its scope, but the limits change, so check the current rule.

Charitable trusts, religious bodies, cultural groups and sports clubs that receive money from outside India must check their position first. Political parties are barred from accepting foreign contributions.

One practical tip for NGOs: check the donor's route before you apply. A foreign grant that arrives through an Indian affiliate, or as a service payment for a project, can still be treated as foreign contribution if the ultimate source is abroad.

For law and public administration students, FCRA appears in UPSC and university syllabi as a standard case on civil society funding and national security.

FCRA is the checkpoint between an overseas grant and an Indian bank account. Registration, designated banking and annual returns come attached to the money, so check them before you accept it.
